Was anybody at this "April 5, 2011" performance where the stuntman supposively "crashed into a wall"? I'm more surprised that we didn't hear about this mishap around the time it happened and it took this long for it to get out.
Anywho, looks like the drama behind Spider-Man continues...
How can a stuntman sue for getting injured? Seems like an obvious and expected occupational hazard and something that would likely be addressed in the contract he signed.
Cats, I haven't read anything about the case so I won't speculate on any specifics or anything but in the case of negligence a stuntman could sue and certainly win. If it was in the normal line of work, which carries certain risks, a lawsuit wouldn't go anywhere. However, if the producers failed to take certain precautions, ignored warning signs, failed safety inspections, etc. there could certainly be a case.
